Legal Question in Criminal Law in Iowa
My husband went out with friends and got extremely drunk-to the point where he blacked out and does not remember any of his actions. His "friends" locked him out of their house so he tried to find a place to stay (He was not from there). He broke into someone else's home, with no weapons and he had no intent to steal anything. He was only trying to find a place to sleep. The home owners called the police and he was arrested for breaking and entering and was also charged with public intox. He was released on a $3,000 bail. Will he have to serve jail time? If so how long and what other consequenses does he face?
