Legal Question in Criminal Law in Iowa
My husband is on the sex offender registry. For the last nine years he's been a tier two. Mind you we have been married four years and have three kids. He has held a steady job and obeyed all rules. We got a letter last year telling us he has been bumped to tier three the most dangerous. No one will tell us why. Even our county sheriff has no clue why. Are we able to take the state of Iowa to court for this with giving no prop per reason?

He needs to look at Code of Iowa section 692A.102. The classifications are based upon the level of the offense, and he should be able to find the offense he committed which then tells him which tier he should be in. If he has an additional prior conviction, he can be moved up one tier. If he is classified as a sexually violent predator, he is automatically under tier 3.
