Legal Question in Criminal Law in Iowa

Minor Consumption of alcohol

Last Saturday night, me and 9 other

people were at one of my friends

apartments drinking. Around 10

oclock, the police showed up and said

they had a noise complaint. They

came in and ended up giving 8 of us

minor consumptions. A few days

later, we found out that the person

who called the cops was an ex-

boyfriend of one of the girls that was

at the apartment. He said he was a

resident of the apartment complex

with kids, and that we were being

very loud. (He lied to the cops) I

thought it was odd that someone

would be calling the cops for a noise

complaint at 10 oclock on a Saturday

night. Also, later that night, the

police were called to another party,

with kids in high school (I am in

college) and let them all go. And

there was more people at that one!

Isn't that discrimination of some

kind? Do you think there is any way

I can get out of my ticket? I am

going into elementary education and

really don't want this on my record. I

can understand if I was at a big party

that was out of control. But the fact

that it was 8 PEOPLE and it was a

false report! What do you think?

Re: Minor Consumption of alcohol

It doesn't matter how the police found out that there was a party going on and that people were drinking who shouldn't have been.

Also, it doesn't matter how other folks in a similar situation would be treated.

As to how you can get out of the ticket, you're pretty much stuck, but you could ask for a deferred judgment.
