Theft 2nd is a Class D felony punishable by up to 5 years in prison. It is not a forcible felony, which means that it is not mandatory that she go to prison, unless she has 2 prior felony convictions which would make her an habitual offender and requiring a 15 year prison sentence. Its impossible to speculate on any individual case as to what the outcome will be for your mother. Much depends upon her background, her criminal history, the underlying circumstances of the case, the wishes of the victim, and so on. She should consult with an attorney to assist her through the charge.
