Legal Question in Criminal Law in Iowa
Through the process of our divorce, my ex-wife was residing in our home as put forth in the Dissolution Decree. She stayed there for 2-3 months then left without cleaning out the house and failed to lock the doors. As a result "someone" turned on a bath sprayer upstairs and located it so as to flood the house. She claims it is not her responsibility because she did not live there anymore. Can I pursue a negligence or mischief charge to aid in fixing the water damage? Can I get a civil penalty to offset the repair?

It's doubtful that you can recover any of this and yes, the act was that of a third person so she's off the hook legally speaking.
