what is punishment
can a person serve jail time for a 200.00 bad check if the person wants to make restitution on check but isnt the first time for bad checks

If you're convicted or plead guilty yes. It depends on what you ultimately are convicted of. As a practical matter the best way to deal with these things is to make restitution up front, because your'e going to have ot pay anyway.
