Legal Question in Criminal Law in Iowa
Questions about probation
I am currently on a 1 year probation and I am reaching the end, I have a few months left.
However, at the time of my sentensing my attourney told me that their is a good chance that my probation would be cut short after all the restitution was paid.
First of all, I am wondering if this is something I have to push to happen, or does it just happen? Do I have to bring the case back before a judge or how would that happen?
Secondly, I am wondering how you tell when your probation is over? I recieved a letter from ''the governor'' saying that I was able to vote now and it said something about my case and probation, I wondered if this letter ment that my probation was over but I was not sure. So how do you know if your probation is over, do you recieve a letter or what? Is their someone that you can call at the court house that could look up and see if you are on probation still?
Lastly, if my probation is not over, I am wondering, when the day comes, one year that is, is it just automatically over or do I have to wait for a letter in the mail or someth? The reason I am wondering is because I am an avid sports shooter, and due to the probation I lost my firearms privilage, and I am counting down the days.
Thanks for the help.

Re: Questions about probation
You want to be absolutely sure that probation is over and that is the province of the Department of Corrections. They can advise your attorney to get a court order discharging your probation.
The other question is something you did not raise, and that is your status relative to firearms. You need to be asolutely clear that this specific right has been lawfully restored because the consequences of FIP have federal ramifications.
