Legal Question in Criminal Law in Iowa
residential treatment facility
I am currently in the residential treatment facility in Sioux City. I have served 20 months of a 5-yr sentence, with the last 12 months being in the RTF. They are keeping me because I owe them back-rent ($600 approx.). My question is: is there a maximum length they can keep me there? (Besides until my discharge date on my 5-yr sentence) If there is no limit, would it be feasible to write a letter to a judge and see if he/she would look into a sentence reconsideration or something close to that? I've completed everything I need to complete, the money is the ONLY thing keeping me there. The counselor I have is the only one in the facility that won't let people out if they owe back-rent. The other two counselors will set up a payment plan if you owe money when you complete their requirements and will release you.

I would need to know more about the facility but you certainly would do yourself no harm by filing a pro se motion to reconsider sentence and ask the court to appoint an attorney to represent you.
