Legal Question in Criminal Law in Iowa
If you were served a search warrant and property was seized and you were arrested for a crime, but you win the motion to supress and all charges were dismissed. Would the state of had to file a forfeiture of seized property at some time? If so how would I go about getting the property returned?

Unless the property is contraband you can retrieve it simply by asking for it. If the state filed a forfeiture and you did not resist it that property is probably gone.
