Legal Question in Criminal Law in Iowa
Subpoena served after trial date
If I had a trial date set for 5/28 and subpoenas weren't served until 6/4 would this have any effect on the case? If so, what is the statue of limitations to address this issue?

Re: Subpoena served after trial date
Your question is posted under criminal law -- so I am going to presume that you were the defendant, and the subpoena's were for your witnesses. You should have requested a continuance based upon the non-service and unavailability of witnesses (if the subopenas were timely submitted). If denied, then it would have been an issue for appeal. A Motion for New Trial needs to be filed within 30 days of conviction, and Notice of Appeal within 30 days of the denial of Motion for New Trial.
