theft fifth degree
My son was caught putting a pack of gum n his pocket and charged with theft. He had a burito and pop as well. He never actually left the store or was even rang up. How could he be charged with theft?

You do not have to remove the item from the store premises. All that is necessary is to intend to deprive the owner of the property and that is done by concealing it on your person.
