What is theft in the fifth degree. this is the first and last time i ever shoplifted

It's a simple misdemeanor, there's a potential for up to 30 days in jail and a substantial fine, but people rarely if ever go to jail on a simple. I would suggest that you ask for a deferred judgment because of your good record.
