Legal Question in Criminal Law in Iowa
time limits on filing misdemeanor charges
I was accused of 5th degree theft. An officer came to my house about 10 min after this had happened. He took my story and went to the place in question to see what they wanted to do about it.This officer didn't show back up to my house for 6 days to give me the complaint but said he hadn't filed it yet with the court. Is this beyond any kind of time limit?

Re: time limits on filing misdemeanor charges
In the case of a simple misdemeanor you will get a court date to appear and enter a plea. Iowa criminal cases must be tried within one year of the initiation of formal proceedings against you. Because there is the potential of jail time you can have the services of a court appointed attorney if you qualify.
