Legal Question in Criminal Law in Iowa
underage drinking
prevously son had arrest for underage driving under influence. Lost liscense but criminal charge dropped to public intox. Now was picked up with violation of Iowas code 123.47. I've read info re first and second offense. I understand it may be the judges decision but with the past history do you feel this new thing be considered a second offense or would the Iowa code violated have to be a match?

I believe that this cannot be charged as 123.47 second offense, if your son was previously convicted of 123.46.
