Legal Question in Criminal Law in Iowa

Waived Pretrial Conference

My fience was wrongly charged with selling to a minor(B) Cospiracy to deliver cocaine(C) and possesion(D). The Judge placed a no contact order on me and our child and charged me with perjury, child endangerment, and conspiracy to deliver marijuana so i can not talk to him. His attorney told him that they waived his pretrial hearing and He just has to go to trial. His attorney said they were going to drop all charges but the possesion charge, give him 4 months time served and 5 years of probation. Is this possible and why would they waive his preliminary hearing? I thought the judge could dissmiss a case at the prelim so i dont understand why they would waive it. His attorney has lied to him before and i was wondering if his att. was just getting his hopes up or if what he said was possible. PLEASE HELP. Our baby is only 1 month old and he already missed the birth. How much more is he going to miss??

Re: Waived Pretrial Conference

If he has a lawyer I suggest he start listening to him. If you have a lawyer I suggest you start listening to him as well.

Preliminary hearings are for the most part irrelevant. What happens is the state files a trial information.
