Legal Question in Criminal Law in Iowa
I was wondering if under iowa code for the underage possesion of alcohol (123.47) if admiting to having a drink from a bottle prior to the traffic stop with a legal adult in the car and the alcohol not physicaly in my possession at the time of the stop if that warrents the charge of underage possesion of alcohol.

Can they charge you? Yes. Should you get convicted? Maybe not. These cases are decided individually, dependent wholly upon their facts, and some judges will follow the law from other states that say that what you have described isn't enough evidence for a conviction.
