Cop didn't issue ticket immediately

My friend who is underage had been drinking but was not driving when the vehicle he was in got pulled over. The cop issued a breathalizer test for everyone in the vehicle and my friend blew .09, over the legal limit. However the cop said he was unsure if he could ticket them and would need to consult an attorney? Can the cop really not issue a ticket at the time of the incident and then decide later to ticket my friend and send him one in the mail? How can my friend fight this? Shouldn't he have been issued a ticket for any laws he broke at the time he broke them or not at all?
