Legal Question in DUI Law in Iowa

Drunk driving

Two people, both in the front seat of a pick-up, driving down the road when the driver dropped a cell phone so the passenger grabbed the wheel resulting in the loss of control of the vehicle and an ensuing accident. The passenger was charged immediately with DUI and the driver was hospitalized. Weeks later after the driver was released from the hospital, the police showed up to his home and arrested him with criminal vehicular injury.

My question is:

Since the passenger already was arrested for DUI can two people in the same vehicle both be charged with drunk driving in the same incident?

The anwer to your question is probably yes, as both were in control of the car at different times in one journey.
