Time limit for arrest
If client was found unresponsive from drug overdose at the wheel, auto in park, engine running, and sent to hospital where drug tests were performed and kept overnight, can the police still charge him with DUI? If so, how long can they wait to file charges. Note that alcohol and initial blood tests proved negative.
Drug in question was ''party drug''. Investigator indicats that he would not pursue case after talking with victims friends. Uniforms left hosopital after initial tests came back OK. PLease advise.

Yes, client can still be charged with a DUI and the prosecuting agency has up to one year in which to do so. If you need additional help with this matter, feel free to contact me.
