Legal Question in Education Law in Iowa
I was attending Michigan Tech University in 2007. I decided to join the Marine Corps, and as per my recruiters suggestion, withdrew from school, which the school had a clause (it has since changed) that said any student may withdrawal for military purposes at any time and receive an incomplete grade. At the time my recruiter wanted me to withdrawal and I started the withdrawal process, I had been through MEPS, and I was waiting on a waiver for a knee surgery I had, otherwise papers were signed and I had a ship to basic training date. Getting the withdrawl process wrapped up, they asked for a copy of my orders, which I asked my recuiter for and he said he sent them to the school and everything was fine. Turns out, the recruiter never sent it in to the school, as well as the recruiter disqualified me because he wouldn't take me to a doc to get my knee checked. So Michigan Tech, did not withdrawal me,failing grades across the board, and expelled me. I appealed their decision to expel me twice, as well as working with the Marine Corps to try and find out why I was disqualified. Just trying to find out what legal action if any can be taken since this did occur in 2007. All I really want is access to my student records for an official transcript so I can continue my degree.
1 Answer from Attorneys
They're required to furnish your transcript and records upon request. On the other hand since it occurred in 2007 the time to take legal action has probably passed. You might want to consult with an attorney in Ann Arbor and see if anything can be done there from a legal standpoint.
