My father was in a nursing home on private pay. I was listed as POC to contract regarding his affairs, and also had Medical Power of Attorney. On two occasions, he was transported to the hospital and the nursing home failed to contact me. They contacted my sister (which we do not talk). I asked them both time to correct their records. They promised they had. Then it happened again. They called her around 0145. I was not notified until the hospital call me at 0200 that he was minutes from surgery. There was no way I could get there and talk to him before th surgery and he passed away. Can I hold the nursing home responsible for not having there records correct?
I feel like they deprived me the change to talk to him one last time.

I do not know of any legal theory you could proceed under that has a reasonable degree of success.
