8 months no words from him does he have any rights to my son?

i have a difficult situation my ex and i broke up and with 2 ways trying to prevent it we got pregnant in last couple months of relationship he got involved heavily in to drugs and i left him because it was apparent he will not quit them even to keep the baby safe i got married and we have a great healthy family now my baby is 8 months my ex didn't contact me till now trying to add me as a friend online does he have any rights to my son 8 months of not caring about him? my current husband care,takes care of and loves our son i want my ex nothing to do with my son he is worse in to drugs and has no education and job.

Was the child born after you were married? If so, the child is presumed to be your husbands, although the biological father can sue to establish paternity. If born before you were married, you could have your husband try to adopt the child.
