Baby last name change

My son's wife left him when she was 4 months pregnant. They are in divorce procedings with the final date being Jan. 29 2007. She had the baby Nov. 7 2006 and gave him her maiden last name. He is paying child support and is up to date with it and has a court ordered visitation. Her last name has not changed. Can my son request the court to change the baby's last name to his and have my son named as the father on the birth certificate? He will be asking for joint physical custody.

Your son can file an affidavit of paternity, but as far as naming conventions the court probably can't order mom to do anything in that line.
