Baby's last name

Recently had the birth of my son, at the time i needed to do a paternatity test to prove he is mine, now that the results have come back and prove that he is mine, i want him to have my last name. he is 4 weeks old and just now getting a birth certificate and soc card. Do i have the right to have his last name be mine or can she refuse?

In a word, without any court order to the contrary the answer is yes.
