Legal Question in Family Law in Iowa

birth certificate/paternity test

My son is incarserated and was when his girlfriend had a baby. She put him down as the father of the child and also put the baby in his last name. She had other affairs with other guys but states that my son is the father. What is the law in IA about Birthcertificates does the father have to be present if not married to sign birthcert and can the mother put the fathers last name on the birthcertificate not knowing for sure if he is the father.

What can we do to get a paternity test done while he is incarserated.

Re: birth certificate/paternity test

What you need to do is file a petition in district court to determine his paternity and the state probably will not pay for it. The father is not required to be present or sign an acknowledgement of paternity to be considered the father. If any amount of time has lapsed it will be much more difficult to unseat paternity. There is also the possibility that he is determined to be the biological father.
