Legal Question in Family Law in Iowa
Ok my boyfriends with passed in 2013 they have 2 kids 1 a minor. He lived with his father up until he moved out of the school district. And his adult sister wanted to have him stay with her so they wouldn't. be split apart. And so he could attend the same school he had been going to. But she ditches him at their deceased mothers step brothers and now they want child support. Not to say they are getting $650 in ss already. Plus I know for a fact if they use his and his wife's income they would prolly owe Scott the minors father. And granted we Scott hardly ever see him the don't push for a relationship with his father at all. He never calls, or anything. They asked for guardianship or told Scott the were taking over guardianship so they could take him to the drs. Ect. But it is panning out that all they wanted is child support. Scott lost his ss $650 from his wife's passing cause he started working. But he brings home $650 to $700 every 2 weeks. He cannot afford to pay anything. So what can he do to stop this child support. And is it right to use the deceased parents income $0 or the 2 adults he lives with income. Hope that helps.

Well, without a custody and support agreement signed by a judge or in the alternate a support order from the CSRU nothing's going to happen. Who is the legal guardian and parent? Nothing can stop them from taking someone to court but whether they prevail depends on the lawyer you hire. Please folks, don't try this at home.
