My husband got divorced from his first wife and they had two kids in their marriage. The divorce decree gave him visitation every other weekend and every other holiday. A few years after the divorce his ex-wife stop letting him see the kids. Twelve years have went by and the kids are now back in his life. He has paid child support all this time. However we find out that she changed the kids last name to her new husbands. Can she legally change their last names with out their biologicals father's consent?

You didn't say how long ago this happened. I suspect too much time has gone by.
