Child Removal

The child was removed for failure to thrive. I asked the lawyer involved what her defense was since the state froze the medical records and was told that the medical and baby's doc. records are NOT pertanent to this case. I want to know why this is? When it was medical (supposedly) why the baby was taken from the home, yet the state froze all doc. and medical records the day they removed the child not even her parents could have them nor get them. PLEASE advise as I am ready to file a complaint with the state board on this lawyer. I have already filed for the paper work.

It is unclear from your question what your relationship to the child & the mother is. If you are the father, you are entitled to participate in any dependency action; however, paternity would have to be established first. I am an Arizona attorney, but I assume that Iowa follows the same general outline as Arizona. The courts handling the matter would be where the child was living. If you are the other parent and cannot afford an attorney, the court may appoint you one. Your attorney would be able to get access to all the information in the case, even reports that may otherwise be sealed. If you are a grandparent, you may or may not be entitled to participate in the dependency action. Finally, if you are a friend, these matters are not public, you would not have access to them. Further, lawyers representing another person, may not be able to discuss the case in detail with you, no matter how well intentioned your interest. Good Luck.
