Child support

Question: How to protect my income from my husband�s ex-wife.

I married my husband 4 years ago. He was divorced with 3 children (one, we think isn�t his). The ex-wife left the state, breaking the custody agreement. She filed child support on two of the children. We found out she was living with a man and they were both working full time, and still collecting welfare. My husband was told to suspend payments while she was investigated. By the time payments picked up again, he was off, then we lost about $160,000 in investments, and had to file bankruptcy in June 2001. We�ve just received notice of $20,000 due to child support in Iowa where the ex-wife lives. He�s currently interviewing attornies in Iowa (we live in CA). In the meantime, while we try to find out of this amount due is even accurate, and get his child support payments adjusted to his current income, I have a question: I�d like to know if my income can be protected. I�m a Realtor making straight commissions as an independent contractor. Should I incorporate? Draw up some kind of petition? (We have filed IRS extensions 2 years in a row, so our income is somewhat a mystery right now.)

You should get a consultation with an attorney. How does Iowa have jurisdiction over your husband, did he live there, did he "appear" in the action. You should get the advice of a California attorney who is familiar with interstate jurisdiction as well as protecting your assets. Good Luck, Pat McCrary

they cant legally take your income. just keep it in a bank account in your name only.
