Crossing State lines with young child

My brother's wife vacated their house 2 weeks ago. Now wants a separation and there's a 1 yr. old involved.

She lives in Minnesota and wants to take my niece back with her but because of drugs in the place she's staying at my brother said no, she'll stay with me until you find somewhere to live. If she takes her across the border,is this considered kidnapping? My sister-in-law says it's just for 2 week visitation and then the baby will come back to Iowa but my brother doesn't think that'll happen.

Unless there's a custodial order in place there's no violation of law. She's the parent.
