Custodial parent rights

I am the custodial parent, the child's father recently

moved in. He will be leaving. He had been covicted of 3

DUI charges. He has joint custody of another child, that

lives with him every other week (has been living with us

now, every other week). If he leaves my home, will I

have to agree to allow my child to live with him every

other week. I would prefer every other weekend and one

day/night a week, if he is living a clean and safe life, to

meet the needs of my child.

That sounds like something to be worked out between you and your respective attorneys. There's nothing that says you have to agree to anything. My feeling is that anyone who has three DUIs to his credit represents a potential risk factor that could complicate the negotiations.
