daughter from previous relationship

i had a past relationship with an abusive man (he went to jail) and got preg and had a baby girl, her bio father was there for the birth but then went back to jail for childen endangerment and domestic abuse again.(got 30 days) i got married to my husband now a few months later. its been almost 4 years and i havent heard from her biological father until a few months ago, saying he wants rights. can he really get them? hes not on her birth certificate. is it likely that he would get visitationfor her even though its been so long ago? Does he really have a case?please help me.would it be better if i took him to court? what is the best way to handle this?

What you should have done back in the beginning was get a custody order when the iron was hot so to speak. You now need to go to court and get hte relationship between you and him defined by a judge. While you're there I suggest you get a child support order going too. If you ever had any social services provided for the child or you in that time the CSRU will be glad to assist you.
