My husband's name is still on the mortgage with his ex-spouse, who was ordered to sell the residential property when they divorced, but there was no specific date that the property had to be sold by. The house was never sold and the ex-spouse continues to live in the house with the kids. She has been late making the mortgage payments and twice now we have gotten notice that the home will go into forclosure soon if the mortgage is not brought up to date. My question is, how can we force the issue with the ex-spouse so that she either HAS to refinance the home or sell the property so his name can be removed from the mortgage and he can collect his equity in the home?

What you will need to do is hire an attorney to file for a modification of the divorce decree. If it comes down to the kids being kicked out in the street, don't expect the court to look kindly on the prospect.
