Legal Question in Family Law in Iowa
domestic charges
Me and my husband have gotten into a argument that turned violent. I hit him several times and in the process of him trying to stop and calm me down I had gotten hit in the eye causing a black eye. I was upset and out of spite I called the cops and turned him in for abuse. Now he has a warrant out for domestic and I am stuck with a no contact order. Now that the damage has been done I need to get the charges dropped becuase in all truth its both of our faults. Is there a way to do this?

Re: domestic charges
It is unlikely that you can get the charges dropped, because once the law gets involved the decision to prosecute or not is out of your hands. It rests solely with the county attorney who is prosecuting the case and much depends on how well the investigating officers did their job, prior history of abuse/criminal history of violence and how much interest there is in prosecuting this case, considering all these factors.
If your husband has an arrest warrant outstanding I would suggest that he surrender himself as soon as possible and deal with it. Nothing says guilty to a prosecutor like one who runs from the law.
Until these factors are dealt with in detail, it is premature to consider an effort to lift the no contact order.
