Legal Question in Family Law in Iowa

Emancipation of Disabled Son

My autistic son turned 18 in July. and I found the following on the Office of Child Support Enforcement's IL Profile page: ''Under Illinois law, the duty to support ends at the age of 18 unless the child is attending high school or the the support order stipulates a different age. Illinois extends support to age 19 if in High School and documentation is received.'' My son is enrolled in Davenport Central, but I have attendance records showing he has not attended more that 2 days since school started. Would the court consider enrollment or attendance as the determining factor in when to end his support?

Re: Emancipation of Disabled Son

The court order says "attending". School started in September and it's now the end of January. You can hardly call two days "attending".

You might ask the school what they consider "attending".
