Legal Question in Family Law in Iowa
My Ex-husband is taking me back to court and trying to modify custody of our 3 Year old. Per our Divorce Decree filed in 2009, he currently has every other weekend and Wednesday evenings, 3 weeks in the summer, and a standard rotating Holiday schedule. His Petition claimed that he would like 50/50 custody and reduced child support. During mediation, he claimed he is going to be a full time farmer and will have more time to spend with our daughter and that she should have equal time with both of us. As of right now, he has not sold his business, and is now farming along with his equipment repair business. We go to court in September. We both have stable homes, however when our daughter is with him, his wife primarily cares for her (bathes, dresses, feeds etc) They both work Saturday mornings, so frequently my daughter is left with his mom (her grandma). Does he have a very good chance of getting custody modified? My lawyer does not think so, but I have a hard time believing my ex's lawyer would even suggest going to court over this, if he didnt think he might be able to get the modification passed by a judge?
