Family Law & Deduction Rights

I, as my childrens father have custody of my three children. Now, my ex-girlfriend was ordered to pay child support but has only paid $53 on what is now over $1000 on the back owed plus $100 monthly ordered to start last Dec.. My question is, if it was not specified under the custody orders, is she entitled to file for the tax deducion on them?
