Legal Question in Family Law in Iowa

Filing False Court Documentation

My daughter is requesting post-secondary education

support. We were served with papers in which it stated

she was attending a specific college full-time. We

have learned she is not enrolled in that college at

all. Can her attorney be held legally responsible for

giving the court untrue information. And should we be

responsible for any college support when they are

misrepresenting information?

Re: Filing False Court Documentation

It is likely the attorney knows only what the client told him or her regarding the child's education status.

Get a certified copy of the child's attendance record and/or status

from the college. Attach it to a motion to declare the child emancipated on the grounds that your daughter is not attending college full-time.

Then ask for your attorney's fees and other costs.
