Legal Question in Family Law in Iowa

guardianship and child custody rites

The father is to provide medical insurance through his employment for the child Since the divorce he is no longer employed. The petitioner(father) shall pay all medical cost for child not covered by insurance. Is the father in contempt of court for not providing medical insurance?

The grandmother wants to gain gardianship of the child in order to put the child on her insurance. Is this legal? And do the grandparents have a right to do this? She wants the mother to sign her rites over for guardianship.

Re: guardianship and child custody rites

The father is in contempt but one must bring an action to raise this issue. Dragging people into court who don't have any money is generally unproductive.

I would think that guardianship, in and of itself, might not be enough to bring a child under the medical insurance umbrella.

Grandparents have no rights per se.

The mother does not get to sign over her parental rights. They can be taken away but that's it.
