Legal Question in Family Law in Iowa
My husband is very abusive towards me and my 4 year old step-son and I can already see him starting with our 3 month old by screaming in his face. We are getting a divorce and he wants joint custody. He has major anger, abusive, alcohol, and controlling problems. He has even caused 3 miscarriages by kicking me. What are the chances that he will get joint custody? Also, I am still breastfeeding our 3 month old son.
There is an Order of Protection and at the court hearing we agreed that he files for the divorce so that he can deploy because if he has the Order of Protection still in place he cannot deploy. We also agreed that visits would be once a week for 2 hours supervised due to the abuse and alcohol problems and NO parenting skills. Now he wants joint custody. I am breastfeeding. Everytime I try to let my husband hold our 3 month old the baby cries and my husband will scream at him to shut up. My husband and his mother call him "The Mistake". I don't want him to grow up thinking that he was a mistake when he was well planned out even before we got married and we have been married for 3 years. I have moved out and I have temporary custody of our 3 month old and we are trying to make it on our own. My husband has already broken the Order of Protection by contacting me online a couple times in the last week. What are the chances that he will get joint custody and what are the chances I will get sole custody?

I'm not in the business of speculating about such things. What does your attorney think?
