Legal Question in Family Law in Iowa

my husband and are have seperated and not yet filed for divorce or custody of our two children. we both live in the same state, he has our children living with him currently and is refusing me any kind of visitation. what would happen if i went and picked up my children? foes he have more rights to them currently than i do?? i cannot afford a lawyer and he hasnt filed either. i have also found out that his previous marriage never got granted a divorce but we are now married also? what do and can i do? and is that legal? if not what kind of trouble will he be in?

If you and yuor husband can't work things out you two will spend thousands of dollars on legal fees to have the Court straighten it out for you; and still neither of you will be satisfied. As the mother you have the right to pick the children up and to keep them. If he continues to refuse you visitation with the children you should go to legal aid, assuming your can't afford legal services, and file for divorce or a legal separation. How old are the children?
