Legal Question in Family Law in Iowa

Legal Name Change

I am a father of two daughters, a 6 year old and a 1 year old where the mother gave each of them her last name. We were never married. Neither has custody. I am involved with them and do pay child support. She is now married and I believe wants to change their names to her husbands last name. They and I both live in Iowa, but both daughters were born in Nebraska.

Can she do that without my permission? Do I have any rights to change their last names to mine? Is it too late?

I do have other children from another relationship that do have my last name even though we were never married. I always wanted them to all have my last name, but I wasn't on my 6 year old's Birth Certificate until just before she was 5, and on my 1 year old's birth certificate since she was born. I thought it was always up to the mother and that I had no rights when it came to their last name. Thanks

Re: Legal Name Change

If you do not have a custody and support order in place you have no standing to complain about anything the mother does, because legally speaking you're out of the picture.
