My Sister is dying of cancer and her daughter has medical power of atttorney. My sister is married but seperated from her husband, and lives with her daughter. He is mentally abusive to her and has been physically abusive. If she becomes mentally uncapable of making decisions can her daughter some how apply to get guardianship of her and take over her finacially affairs. Or does the husband have all the rights??? And can he change her medical power of attorney??

Anyone can apply to be her guardian. She can give over a medical power of attorney to anyone she pleases. She can also give a power of attorney over her financial affairs to anyone.
