Legal Question in Family Law in Iowa

Medical Release of Information in Divorce

I am a divorced father of two great boys, the reason for the divorce is because I suffered from depression and my ex did not want to deal with my disease. During the court appearences my lawyer said I had to sign a release of medical information so my now ex could see my pychiatrist information would be available to her. I signed it and she received copies of my records. I have not seen a doctor for several years now and am doing much better. I have not needed medication or anything else because of my faith in God that he could heal me which he has done. My question for you is now after several years she wants my records again I signed the release of information but I said that she could not have a narrative of our conversations. Now she is taking me back to court for saying I have went against a court order. Don't I have the right to give her the information but without specifics of what we talked about? I am from Iowa and need some help because I have just been served by a sherriff for a court appearence on the 5th of December. Can you provide some information.

Thankyou,

Matt McKinney

Re: Medical Release of Information in Divorce

I assume that you will have an attorney representing you when you go to court?

I do not understand why it is that she requested your medical records several years after the divorce and I really do not know what you agreed to provide. Generally speaking reports of treatment are disclosable but the actual narrative of treatment are privileged. Your attorney should resist this request.
