Legal Question in Family Law in Iowa

Getting name off mortgage loan

Divorced 3 years ago; I quit claimed house to ex with stipulation of refinancing in 6 mos (did not stipulate sell); ex has not sold house, but this wasn't an issue until now. He wanys to do land contract to his deadbeat sister and I don't want any part of that. I want my name off the loan or somehow deny contract sell. Do I have recourse? (By the way, he is behind child support, was supposed to garnish wages, but hasn't turned in forms to employer) My lawyer says "Sorry ... I screwed up!" That's not good enough. Help!

Re: Getting name off mortgage loan

I'm licensed in Tennessee, not Iowa, but most states allow you to return to court to modify or clarify or correct court orders in situations like you are talking about with the mortgage. You also could approach the mortgage holder to see what you need to do with them to get them to release you.

You also can take the ex back to court for contempt regarding the child support.

And don't forget you can always use another lawyer if the one you have now seems brain-dead.
