Legal Question in Family Law in Iowa
I have been having an ongoing problem with my daughter's father not abiding by our child support agreement. He has never paid the 52% of out-of-pocket medical expenses. He says that he pays enough in child support and shouldn't have to.
Also, I have two Child Support Guideline Worksheets. One states that he is to pay $276 per month and carry insurance for her. The other states that he is to pay $328 per month if he does not. When he received these worksheets, he set up a hearing because he didn't agree with the amounts. He never showed up to the courthouse and the child support case worker who represented me requested that the judge order him to pay $276 per month and carry insurance for her. He has only had insurance for her a total of three to four months. It paid for one dentist visit. This was ordered September of 2006. Am I owed the difference since he was only paying $276 per month instead of $328 while not carrying insurance for her? Also, should he be responsible for paying me back the money I spent on dental coverage for her for 11 months?
He is over $6,000 in arrears, pays child support for on more child, just had another baby and just got married.

All you really can do is take him back to court. I see you are in Illinois so I cannot comment on what he is required to do there but I would suggest that you contact the Child support Recovery Unit in Iowa and get them involved, if you have not done so already. The basis for their involvement is as simple as you receiving any government benefit-food stamps or WIC is enough to do that. I expect your home state has a similar process.
