Over Payment of child support
My son graduated in June of 2006. He did not go onto college. I found out in October I was no longer obligated to pay support. I am still paying on him as well as my youngest son. I did get an attorney and we have been trying since October to get my ex to sign the papers and she refuses. What happens to the overpayment when this is finally settled? My attorney tells me that I may not have to pay support for my youngest util this overpayment is caught up. Is this true?

If you're paying an attorney the best thing you can do is ask them. Your ex wife does not have to sign anything for you to petition the court for a modifgication of the existing order, to wit-the child is no longer eligible. Yourattorney is talking about setoff. It's a good idea.
