Legal Question in Family Law in Iowa

PostSecondary Support

With Iowa Code 598.21F, and divorced and support filed after 7-1-1997.Can the non custodial parent modify the decree and seek postsecondary support? Even if the non-custodial parent agreed to pay all of tuition at the beginning? What cases can I refer to in this matter? The 18 year old is not phsyically or mentally challenged and has all ready entered freshman year of college. If so, what support is required; tuition, room & board and what else? Everything? The statute doesn't really indicate what it's to include.

All that code section does is suggest things that the court should consider in making a division of property. There's no specific instructions as to how support is to be divided.

One would have to go back to the original decree and argue from there. Certainly if the circumstances change a person could seek to modify the original decree.
