My girlfriend is emmancipated from her parents but has recently moved back in with them. She is only 16 and I am 18 is it legal for us to date and can her parents press any form of stagatory rape on me if she is legally emmancipated?

The answer is yes you can have a friendship but you are prohibited by law from engaging in acts of a sexual nature. It matters not that she is emancipated form her parents. You could be charged with indecent contact with a child up to and including lascivious acts with a child, because a 16 year old person is a child legally speaking.
