Legal Question in Family Law in Iowa
responsiblity for stopping child support
Who is responsible for stopping Child Support requirements after the child is over 18 year old on no longer in school? Currently the Clerk of Court handles what is owed based on the divorce decree. The person paying the child supports believes they do not owe support and has obtained a lawyer who is threating to take me to court if I do not sign a Satuatory Release and Satisfaction of Judgement form. Isn't it the Clerk of Court's responsible to determine if support is owed base on the Divorce Decree? Payments were required to be paid to the Clerks of Courts office.

Re: responsiblity for stopping child support
The person who pays is responsible for going to court and ontaining a court order terminating support. You might have to appear in court but so what?
Do not sign any statutory release and satisfiaction of judgment. It's between the payer and the court.. Of course, if he's overpaid and you have the money you might have to give some of it back.
